DFDA and Civie Law

I know this is an old post, but just to clear some aspects up.

1. A defence member that is charged in civie land cannot be charged under the DFDA for the same crime. How ever there are ways and means around this. The common charge an ADF Member will face for being charged in civie land is s60 Prejudicial Conduct. So for example an ADF member is pulled over and returns a positive BAC reading (>0.05) then he/she will face civie court then can be charged under s60 within the military. However if an ADF member is driving an ADF motor vehicle and returns any BAC reading >0.00 then he/she will face a number of charges within the military.

2. An ADF member who is charged in civie street there are possible to course of actions that can be taken. Depending of what the charge is DPP can hand back to the ADF jurisdiction for the charges. This has the advantage that it frees up civie courts, and as a general rule punishment within the ADF is harsher than civie punishment.

3. NAVAL Police, do not have jurisdiction outside a Military base. Their authority (unless we are at war) starts and stops at the main gate. How ever at the request of WAPOL NPC's can have their authority extended under special circumstances.

The blue falcon that is seen in this post has been retired as has the Toyota Troupie that is parked next to it. NPC now have a late model camry with dashboard lights and roof bar, as well as a Toyota hilux Prisoner Pod van (same as WAPOL) use
